Seller warrants that the property sold hereunder will be free of defects in material and workmanship for a period of one year from the date of delivery. Should Seller determine the property, or any part or portion thereof, to be defective in material or workmanship, upon delivery of the property to Seller's place of business, Seller will repair or replace the property. It is expressly agreed that the liability of Seller, and the remedies of Purchaser, shall be limited to the replacement and repair of the property sold hereunder in accord with the said warranty, and there are no other warranties or representations with respect to the nature and quality of the property sold hereunder. Any other warranty is hereby agreed to be inconsistent with such warranty, and it is the intent of the parties to specifically DISCLAIM THE WARRANTY OR MERCHANTABILITY AND THE WARRANTY OF FITNESS.
Any cracking of a water tank that is subject to water hammer is not covered by
any Hanson warrantee. Water hammer can be caused by air activated valves in wash
downs or large laundries. Hanson will always assume that when such valves are
in a system air hammer does (or has) existed.
Other examples of tank failures not covered are stress cracking of stainless steel tanks, and damage caused by electrolysis in conventional hot water storage tanks.
